Friday, January 29, 2010 AllianceBernstein Beats Back Accusations of Discrimination Retaliation AllianceBernstein shut down a lawsuit involving claims of age, race and sex discrimination, as well as retaliation for investigations of those practices. On January 6, a federal judge in New York dismissed (pdf) the entire suit brought by Rosanne Peress against the mutual fund firm, thanks to an apparent settlement (the terms of which were not disclosed). A spokesman for the New York-based asset manager declined to comment on the case. The MFWire could not immediately reach Anne Vladeck of Vladeck, Waldman Elias & Engelhard (who represented Peress), or Michael Delikat of Orrick, Herrington & Sutcliffe (who represented AllianceBernstein), for comment. The dismissal and apparent settlement appears to have narrowly preempted a full trial. On November 24, 2009, U.S. District Judge Kevin Castel had scheduled the final pretrial conference for March 15, 2010 (with discovery and expert discovery due by February 2 and 19, respectively). Peress, a nearly 15-year AllianceBernstein veteran, had served as senior vice president of human resources and administration at the firm. She left in February 2009 and filed suit (pdf) in May.
