Morgan Stanley has prevailed in a suit brought by an investor who claimed the broker-dealer had failed to disclose incentives to brokers related to the hid fees in it levies on B Shares. The suit also alleged that B shares are never an appropriate vehicle for investors.
Reuters reported that the suit was dismissed by Judge
Todd Campbell of the U.S. District Court in Nashville last week.
"The prospectus at issue discloses information which would permit any investor to determine the 'best' investment for him or her, under the circumstances," wrote Campbell in his opinion according to the news service.
