It may be difficult for the mutual fund industry to fight against increased regulations of gold and commodities funds, according to a Wall Street Journal report.

It may even be too early to challenge to ruling by the Commodity Futures Trading Commission, according to federal appellate judges.

The ICI is arguing that the SEC already regulates these funds, negating the need for oversight from the CFTC.
